1. Introduction
Welcome to HushGrovePath ("we," "our," or "us"). These Terms & Conditions ("Terms") are the rules and regulations for using our yacht charter services and the website at hushgrovepath.sbs (the "Service") provided by HushGrovePath.
By reserving a yacht or using our Service, you consent to these Terms. If you do not accept any part of the terms, then you are not permitted to use the Service.
2. Service Overview
HushGrovePath offers a range of high-quality yacht charter services that include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are contingent on availability and suitable weather conditions. We reserve the right to change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be at least 18 years old
- Provide accurate and comprehensive information
- Submit the required deposit as indicated in your reservation confirmation
- Conform to these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed only with the payment receipt and our written confirmation. We have the authority to deny service to anyone at our sole discretion.
3.3 Availability
Charters depend on the available vessels and favorable weather conditions. We will strive to meet your preferred dates and times whenever feasible.
4. Payment Terms
4.1 Pricing
All charges are provided in € and cover all appropriate taxes unless stated differently. Prices may be amended without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the full charter fee required at the time of booking
- Balance: To be paid 48 hours prior to the charter's start
- Additional costs (if any): Payable at the end of the charter
4.3 Payment Methods
We accept most major credit cards, bank wire transfers, and certified cheques. Our payment processes are carried out using secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full reimbursement minus processing fees
- 24-72 hours before departure: 50% reimbursement
- Under 24 hours before departure: No reimbursement
5.2 Weather Cancellations
If the captain determines that weather conditions are not safe, we will propose to:
- Reschedule your charter to another suitable date at no extra charge
- Refund in full if rescheduling is not an option
5.3 Mechanical Issues
Should there be any mechanical issues with the vessel designated for your charter, we will try to provide an appropriate alternative. In the absence of an alternative, a full refund shall be given.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Comply with instructions given by the crew
- Use safety equipment when required
- Inform us of any medical conditions impacting their safety
- Stay within the designated areas on board
6.2 Prohibited Items
The following are not allowed on the yacht:
- Glass bottles
- Illegal drugs
- Firearms or any weapons
- Excessive amounts of beverages (beyond reasonable personal consumption)
- Animals (unless given prior authorization)
6.3 Conduct
Travelers are expected to behave respectfully. We hold the right to end a charter prematurely without refund if a traveler's conduct endangers safety or affects other guests' experience negatively.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the payment received for your charter. We are not liable for:
- Injuries due to passenger carelessness
- The loss or damage of personal items
- Unforeseen, indirect, or punitive damages
- Postponements caused by weather or situations out of our control
7.2 Insurance Coverage
We uphold comprehensive marine insurance that covers our vessels and operations. Passengers are advised to obtain their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our yacht services, you recognize that nautical activities carry inherent dangers and you assume responsibility for your personal safety and welfare.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, routes, or timetables owing to meteorological conditions, safety concerns, or operational needs. Efforts will be made to ensure substitute experiences are comparable.
9. Force Majeure
Our responsibility does not extend to interruptions, annulments, or amendments due to uncontrollable circumstances, such as but not limited to:
- Extreme weather phenomena
- Natural disasters
- Governmental decrees
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
Your private data is managed according to our Privacy Policy. By utilizing our services, you agree to the accumulation and usage of your data as detailed in our Privacy Policy.
11. Intellectual Property
Content displayed on our website, including text, visuals, trademarks, and images, is safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited without our explicit consent.
12. Governing Law
The enforcement of these Terms is subject to the laws in force within Monaco. Any disputes will be settled in the courts located in Monaco, Monaco.
13. Changes to Terms
We reserve the ability to update these Terms at any time. Any amendments will be publicized on our website with a note of the revision date. Subsequent use of our services implies acceptance of the updated terms.
